1. Acceptance of Terms

By engaging with Cinêrgy Studios (“Company,” “We,” “Us,” or “Our”) for videography, photography, and social media marketing services, you (“Client”) agree to be bound by these Terms of Service. If you do not agree with these terms, you may not use our services.

2. Services

Cinêrgy Studios offers videography, photography, and social media marketing services, including but not limited to, video shooting, photo sessions, content creation, post-production editing, social media strategy, and account management.

3. Payments and Fees

3.1 Payment Terms: All services must be paid in full according to the agreed-upon payment schedule. Payments can be made via Cash, Bank Transfer, PayPal, Cash App, Apple Pay, or Venmo.

3.2 Deposit: A 30% non-refundable deposit is required to secure our services for your project. The remaining balance is due 7 Days before the delivery of the final product.

3.3 Late Payments: Late payments are subject to a 5% late fee per week. If payment is not received within 30 Days, we reserve the right to suspend services and retain all deliverables until payment is made in full.

3.4 Refunds: All payments are non-refundable unless otherwise agreed in writing.

4. Intellectual Property

4.1 Ownership: Cinêrgy Studios retains ownership of all raw footage, photographs, and content created during the project. The final edited product will be delivered to the Client under the agreed licensing terms.

4.2 Licensing: Upon full payment, the Client is granted a non-exclusive, non-transferable license to use the final product for the purposes agreed upon. Any use beyond the agreed-upon scope requires additional licensing and fees.

4.3 Credit: Cinêrgy Studios reserves the right to use any work created for promotional purposes, including portfolio display, website use, and social media, unless otherwise agreed in writing.

5. Revisions and Approvals

5.1 Revision Policy: The Client is entitled to 2 rounds of revisions on the final product. Additional revisions will incur an extra fee of $100.00 per revision.

5.2 Approval: The Client must approve the final product within 7 days of delivery. If no response is received, the product will be considered approved, and no further changes will be made without additional costs.

6. Cancellations and Rescheduling

6.1 Cancellation by Client: If the Client cancels the project after the deposit is paid, the deposit is non-refundable. If cancellation occurs within 48 hours of the scheduled service date, the Client is responsible for 50% of the total project cost.

6.2 Rescheduling: Rescheduling requests must be made at least 72 hours before the scheduled service date. Rescheduling is subject to availability and may incur additional fees.

7. Liability and Indemnity

7.1 Liability: Cinêrgy Studios is not liable for any damages, losses, or claims arising from the use of our services, including but not limited to, delays, errors, or omissions in the final product.

7.2 Indemnity: The Client agrees to indemnify and hold Cinêrgy Studios harmless from any claims, damages, or expenses arising out of or related to the Client’s use of the final product.

8. Confidentiality

We respect the confidentiality of all Client information and will not disclose any details of the project without the Client’s consent, except as required by law.

9. Termination

Cinêrgy Studios reserves the right to terminate the agreement at any time if the Client fails to comply with these terms, including non-payment or misuse of the final product.

10. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Texas. Any disputes arising under these terms will be subject to the exclusive jurisdiction of the courts in Texas, USA.

11. Amendments

Cinêrgy Studios reserves the right to amend these Terms of Service at any time. Any changes will be communicated to the Client in writing and will take effect upon acknowledgment by the Client.

12. Entire Agreement

These Terms of Service, along with any signed contracts, constitute the entire agreement between Cinêrgy Studios and the Client. Any changes or additions to this agreement must be made in writing and signed by both parties.
